Legal Question in Medical Malpractice in California

Missed tumor

My mother died at 63years of age after pancreatic cancer or complications from surgery. Two weeks after they discovered the tumor she passed away.She had been under the care of several different specialists for at least 2 years.

May 2001 she had a heart attackafter leaving from an outpatient procedure. Which ended with stent surgery. She told me she had mentioned heart pain to a Dr.? a month or so back and asked for an EKG but was told it was not needed. She told me she later learned that she could have demanded an EKG. She had already been seeing one doctor. for rhuemtoid arthritis,a skin doctor,another for divertyculitis,heart doctor,ect.

In and out of hospital with the doctors in and out of her and no doctor ever found any tumor or cancer? Bye the time they found the tumor it was a fluke. when they again inserted a special camera (which they had done several times already) they could not get the camera in because the tumor was so LARGE.

What they put her through in the last 6 months of her life blows my mind. A healthy person would have a hard time taking that type of physical battering, let alone a woman with cancer being treated for just about everything else but cancer.

If you are asking me whether or not you and your mother's family have a cause of action for medical malpractice, I am going to need additional facts before I can accurately assess your case.

For example, I am going to need to know the specialties of the various doctors who were treating her during the time the tumor was growing. I am going to need to know what type of tumor it was (i.e. benign or malignant), if the tumor spread, and what part of the pancreas that the tumor affected and how it physiologically caused her death. If the death was in fact premature and what the autopsy report said as to what the cause of death was. Further, I am going to need to know what the other illnesses that she was being treated for. Once we have all of this information as well as the medical records I will be able to tell you whether or not you have a case for failure to diagnose.
