Legal Question in Medical Malpractice in California
my six month old baby died 3 days after ER visit
my baby died of chronic bronchialitis, when the doctor learned of this she suddenly claimed that she knew nothing of any breathing problems, i have documents and other things that prove differently please help us to know if we have a lawsuit or how we should go about starting one. He was our life as well as the little brother of 2 other siblings. I had him in the doctors office constanly and I know someone is at fault please help us.

A malpractice claim may be present but requires a detailed review of the records and the retention of a doctor who after the review is of the opinion that there was malpractice. Medical Malpractice is extremely hard to prove. You have to show that the doctor knew something was wrong and was negligent in treatment of the condition. Having written proof is the first step in prooving your case. I would also go immediately and get a copy of your child's medical records. You never know if something will be destroyed to cover tracks. I would need additional information before I could tell you whether it is worth going through the pain of a Court battle. It certainly sounds like this matter warrants further investigation. You should request a copy of any and all your son's medical records. To do this call each medical provider and ask who to direct a request for copies of the records and send your written authorization requesting the records.
I would be happy to meet with you to discuss your case. HOwever, be aware that you will need to act relatively quickly. There is a statute of limitations and depending upon who the treating physicians/hospitals were you may have to meet deadlines for the filing of administrative claims.
