Legal Question in Medical Malpractice in California

hi my question is would a dr or insurance co be responsible for feeding an addiction and not spottting it before it got out of control to pain meds? the pt conned the dr with false reasons with emails through the health ins website and would be approved . is that negligence?

A doctor in the same type of practice would have to give an opinion, that under the circumstances, the doctor should have acted differently. A doctor would need more facts.
