Legal Question in Medical Malpractice in California
This was my question:
Why in the Conrad Murray case, during the verdict Michael Jackson was still stated as alleged victim?and waht does alleged date means?
Verdict:
Superior court of California Los Angeles County. The people of the state of California plaintiff versus Conrad Robert Murray defendant. Case number SA-073164. Title of court and cause. We the jury in the above entitled action find the defendant Conrad Robert Murray guilty of the crime of involuntary manslaughter. In violation of penal code section 192 subsection B alleged victim Michael Joseph Jackson alleged date of June 25th 2009 as charged in count I of the information.

When the verdict form was drafted, Jackson was still an "alleged" victim, because Dr. Murray was then presumed innocent. Obviously, that's no longer true.

My new question:
Excuse me but I've never heard a verdict where the victim is alleged and where the date of death is known to be certain it is alleged.
I searched other verdicts with words alleged victim and alleged date, but I found none. I searched a form of the verdict with these words but I found none.
I have seen other verdicts like Shott Peterson, James Arthur Ray, OJ Simpson and in none of these cases the victims are alleged and in none of these cases there are dates alleged.
When the verdicts were drafted Shott Peterson , James Arthur Ray, OJ Simpson were not presumed innocent? Why in the verdict in these cases there isn't an alleged victim and an alleged date?
The form of the verdict of Conrad Murray is wrong?

Who cares? De minimis non curat lex. Any error in the phrasing of the verdict form lies with whichever attorney drafted it, or with Judge Pastor who approved it.
