Legal Question in Medical Malpractice in California

During my first week of surgery,in dec.2005,They send me home with a kidney infection,I returned three times,I had a foley catheter and a superpubic catheter.They would just give me a shot for pain and send me home.Since the surgery they would contact the DR and he never showed up to se me.I never saw him again after surgery.On jan.3 2006 I was so sick I lost 25lbs and they finally took out the superpubic catheter,my body was poisened,and they just send me home.A week later I was so ill I returned and was admitted because my liver was inflammed.I went to see a specialist and for the past two years I have been going to the doctor and all they say is your fine.In march of 2008 I went to a different county to see a new doctor because the pain on my side that has not gone away since my surgery.Now I found out that I have a bad infection in my kidneys and my white blood count is high.Can you give me advice of what i can do or if I have a case.Thank you

It's gonna be tough because of the short statute of limitations in medical malpractice cases. If you are willing you can get an attorney to collect the records and review the case both from a medical and a legal point of view. But, the doctors reviewing the records will charge you for their time and expertise. Figure about $4,000. If you have no case, that will have been $4,000 down the drain.

The first thing to do is to get well. You were wise to seek out another doctor. Consult with a medical malpractice attorney in your area as soon as possible. The attorney will need all of your medical records, including tests, for an expert review to decide whether you might have a case. There are strict deadlines for filing a case.
