Legal Question in Medical Malpractice in California

Tubal Ligation

had tubal about 4 yrs ago.became pregnant.signed consent form for another tubal on time.At 7 months went to hospital with pain from a uti.stayed overnight with pains. nurse had trouble monitoring fetal heart rate the whole time. was sent home next day still with some pains.2 hours later came back and fetal heart rate was at 60. emrgency c-section needed. i asked to have my tubal done at that time,they had all my paper work since the first day I was admitted. Nurse tells me she doesn't have the consent form and is not able to do my tubal. they lost my paperwork. what legal advice can you give me and is this a reasonable lawsuit? I already had four children when I had my first tubal.

Once cannot evaluate a medical malpractice case without first getting the medical records and having them reviewed by competent experts. The threshold issue is how serious are your damages. Med Mal cases are expensive to litigate, and only large dollar cases justify the expense and risks.
