Legal Question in Medical Malpractice in California

Wrong Name on Perscription Form

I took my 10 year old daughter to the emergency room at Tulare District Hospital about two weeks ago where she was diagnosed with a kidney infection.

Before even seeing the doctor the person that preformed my daughter's admitting put her name down as something other than her real name.

After seeing the doctor we went to Walgreens pharmacy where instead of giving us the perscribed antibiotic they gave us an antidipressent.

After two weeks of my daughter progressively getting worse, I took her back to the Tulare District hospital, where after a urine sample the doctor on call informed us that the medication they had subscribed previously was the correct one and to up the dose.

A day or two later is when we finally went back to Walgreens to have them inform us of this situation.

Re: Wrong Name on Perscription Form

Serious bodily injury is always a prerequisite to having a viable medical malpractice case. If the failure to give you daughter antibiotics caused her to have serious complications from the kidney infection, that is worth pursuing. If the antidepressants caused her to attempt suicide, it is worth pursuing. Otherwise, it is not.
