Legal Question in Military Law in California
More Fraternization Questions
I am considering enlisting in the
Army in two years as a Specialist
after completing my BS degree. My
fiancee is in the beginning stages of
NROTC to become a USMC
Lieutenant when she finishes school.
My questions: Would our relationship
be considered fraternization under
the UCMJ since we would be in
different branches of the armed
forces? If so, would we be exempt if
we choose to marry prior to her
accepting a commission? Would her
marriage to an Army SPC create any
roadblocks to her being
commissioned?
Thank you

Re: More Fraternization Questions
Marriage before her commissioning avoids all legal problems and cannot prevent her commissioning. After she accepts her commission, a romantic relationship with an enlisted member of any military service is considered fraternization and is prohibited in all services.
