Legal Question in Military Law in California
I'm in the marine corps and just found out that I tested positive for synthetic cannabis but I have never done that?! What should I do to help my case or what steps should I take?
1 Answer from Attorneys
You have to see what action your command tries to take against you. They could take this to Office Hours, a court-martial or try to discharge you. If you want to fight this, you should not accept Office Hours because you will be punished despite your protestations of innocence. You will undoubtedly be busted, lose a months pay and get extra duties and restriction. Then they will try to kick you out with an other than honorable discharge. If you did not do this, you need to fight it and you have no real chance at Office Hours.
However, you can fight it at a court or an administrative discharge board. At either forum, you will be represented by an attorney and can present evidence and witnesses that you did not do anything wrong. This is your best chance to beat this.
Make sure you speak with an attorney before you take any action. DO NOT WAIVE ANY OF YOUR RIGHTS. Fight this as much as you cam.
