Legal Question in Military Law in California
Military Enlistment
My brother has recently enlisted in
the army, however after a couple of
days he has realized that he has
made a terrible mistake. Does he
have any legal agreements to the
army, even though he changed his
mind? If so, what are his options for
getting out of his enlistment
contract?

Re: Military Enlistment
Big question--- has your brother shipped out to Basic training yet?
If so, he is in either the DEP (Delayed Entry Program-for active duty) or the DTP (Delayed Training Program - for reserves and Guard).
Both the DEP and DTP are very easy to get out. Call the GI Rights Hotline ( www.girightshotline.org/ )and they can walk your brother through the process. He does not need a lawyer for this.
If he has shipped out to Basic training, he is legally obligated, but there are still avenues for a discharge. He (or you) should contact either the GI Rights Hotline or a lawyer for help negotiating this.
The important thing is to not give up hope! It is possible to get out of the Army.
Email me if I can be of further assistance.
