Legal Question in Military Law in California
OTH from Marine Corps, then Honorable from Army
I was discharged from the Marine
Corps in 2001 for failure to
participate in reserve activities. I
received an OTH with an RE-4. I
realized that I had made a massive
mistake, and after a long process was
accepted into the Californa National
Guard. I served on active duty for a
year, finished my RSO and was
discharged honorably with an RE-1.
So where do I stand with the Naval
services now? Does my new DD214
and finishing my original service
obligation correct my past errors?
Any advise that could be offered
would be greatly appreciated.

No, you would still have to apply to the Navy-Marine Corps Discharge Review Board.
You could use your post-discharge service and activity to help try and persuade the Board to upgrade.
