Legal Question in Military Law in California
sexual/gender discrimination in ROTC
Last year, I was disenrolled from AFROTC for ''failure to maintain ROTC standards''. I failed three physical fitness tests, all successfully made up. I had either a valid reason for not passing or a medical excuse.
A male cadet, in the same class as me, also failed three tests, without medical waivers or excuses, and is now on active duty with a flying slot. I want to know, if a male can fail tests and remain in ROTC, why can't a female?

Re: sexual/gender discrimination in ROTC
On the face of it this does sound like an inequality. You did not indicate what the actual reasons were for your phyical fitness test failure, nor did you indicate why the other male cadet failed. Were they consecutive failures or mixed in with some passing tests? Were they medical waivers , weight or failure to perform to standards?
More info is needed. Under some circumstances you be able to petition to be readmitted into AFROTC.
