Legal Question in Military Law in California

UA Marine gone 1 day

I left this morning and flew back home from Camp Pendleton, CA. I couldn't bear being there and dealing with the hazing. Being there puts me in a state of constant depression. I'm seeking a discharge. What can I do?

Re: UA Marine gone 1 day

Go back to the unit. This won't get any better for you if you stay away. Either surrender yourself to the authorities or return to Pendelton. The longer you remain UA, the worse this will go. The military does not have to discharge you just because you went UA. They can stick you in the brig. If you're gone over 30 days, it becomes desertion.

The only way to improve your situtaion is to go back to Pendelton, submit to military control, take your punishment, and ask for a separation. But keep in mind that this often means that if you want back in at some later time, or want a security clearance in civilian life, you'll face an uphill battle.

Good luck.
