Legal Question in Military Law in California

USMC UA Question

I went UA from the Marine Corps, and my 31st day between UA/Desertion was in the middle of December. My Family Gets a call the other day from somebody down at NCIS, saying a federal warrant has been issued for my arrest, and they offered to pay my way back if I turn my self in. Before I went UA I was already getting a Admin Sep with a General under honorable conditions for basically being with another woman. I wasn't even getting direct deposit they started paying me in hard check so they can start clearing me out of the system, but I left anyway because they kept bull****ting around with the paper work, I just kept getting the run around, anyway What is the process once I go back? If I call to see if I have been dropped from rolls will they trace my call? How long will it take to get out once I go back, worst case and best case scenario? Where will I stay once I am back...old unit barracks...special barracks....brig? what do I bring with me?? I also just found out I am pregnant and want to turn myself in and get this over and done with so I can live my life with my child without worries. What are my options as far as going back, How long would it take to discharge me?

Going US was a mistake. You recognize that. There is likely a federal warrant, and if they pay for you to go back, it will likely be less problematic for you.

As to the other questions, I would call NCIS directly and ask them. They should have answers for you. But whatever you do, go back as soon as possible. Being gone over 31 days creates a risk of felony prosecution that could ruin your chances at employment later. Also, I think you can expect a bad conduct, as opposed to general discharge now.
