Legal Question in Personal Injury in California

2 days ago my car was struck in a hit and run incident. This happened in the middle of the night while I was sleeping. I am a single mother and this was the first car I have bought myself, needless to say I am absolutely devastated. My question is: I have liability and uninsured motorist insurance. I live in a gated community in an assigned parking spot which I pay for monthly. Normally there is a security gaurd on every night, however on this particular night there was not one. The security office is about 50 feet from my parking spot and had there had been a security gaurd on duty, they surely would have heard my car get hit. There are supposedly cameras all over the complex but not one that points near my parking spot, which is weird because my car is parked in a rather busy area of the complex. The damage to my car is severe and i have only had the car for 4 months. The damage estimate is $3000. There is no way I can afford this and if I can not find who hit my car my insurance will not par either. Is the gated community in anyway at fault and is there anyway that I could prove them liable? Oh and I live in los angeles county California.

I believe that the requirement for a hit and run claim to a vehicle is that there had to be contact with the adverse vehicle. You should have an attorney check Ins. Code � 11580.2, I think is the section. There is a different requirement for personal injury on a hit and run, and ti think that you must have the identity of the person or vehicle that hit you. Your insurance co. should pay you on this less your deductible.
