Legal Question in Personal Injury in California

About 2 months ago my dentist said i chipped my tooth, so i had to go back in and have him fill it. Ever since then I always felt pain in the tooth and recently it became unbearable pain and I went in today to the same dentist to have him check it, he said I needed a root canal and performed one on the spot. The pain was tremendous and I am still recovering from it. I am wondering if there is any legal action i could take for pain and suffering?

Who are you going to sue for your own bad teeth? A root canal doesn't come about due to a chipped tooth, though a tooth weakened by decay and on the verge of needing a root canal may chip more easily. You want to sue your dentist for trying to save you the pain and expense of a root canal by filling the chip first, and then doing the root canal when it didn't work?

As I have answered previously on countless occasions regarding the viability of bringing a medical malpractice case, you must prove that your doctor's conduct and care fell below the normal standard of care of doctors practicing his same profession. You must prove that the doctor was negligent, and that most other doctors would have done things differently. You must pay a doctor to review your facts and give an opinion if the treating doctor was negligent.
