Legal Question in Personal Injury in California

My 3 year old daughter was bullied several times by her 6 year old cousin. She often got hurt physically and she even cut her hair by force hit back of head with scissors and hit her in the chest. Bullying usually occured when no one's looking and the bully denies hurting her. My daughter got sick to her stomach everytime she hears her cousins name being mentioned. That's how we figured out what's going on. We caught her cousin several times hurting our daughter and she denied even when we saw her hit her. Our daughter never told us about it because she's so afraid of her cousin. My husband confronted his aunt who is the guardian of his bully niece (both parents are in the military since her birth) But his aunt believes the bullie's lies and thinks were falsely accusing her grandchild. She also accuse us of hurting the bully. do we have a case?

A case for what? To file a lawsuit, to convince the aunt or her parents, etc.? They are not going to believe you unless you make a video tape of several incidents; since your daughter is scared to the extent of having physical symptoms you can not have her near her cousin, so you cna not come up with any proof that would make them believe how bad she is. Tell the three of them what has happened, you refuse to allow the cousin to be in the same room or even house with your daughter, you know the do not want to see her as being that bad and you can not convince them so you will not try to and both sides should just let the matter rest [then some other mother whose child plays with her will complain to them]. You should take your duaghter to some one with skills in speaking with children to get her to understand she was not at fault for anything that happened, you as parents did all you could, and in the future she must report all such behavior to you so that you can get it to stop.
