Legal Question in Personal Injury in California
2 Year Stature of Limitation Extension.
I was in an accident in December of 09. I am in California and and I know that I have two years two settle with the insurance company. It looks like it might go over the two year mark and I do not want to run out of time. Is there a form I can submit for an extension if need be.
Thanks

There is no such form. You would need a written agreement with the insurance company AND their insured to waive the limitations period in exchange for you agreeing not to file suit before a certain date (which would be well before the extension, of course).
The other answer is correct. It is highly unlikely the insurance company will extend the statute. You should contact an experienced personal injury attorney and have them assist you in filing a timely lawsuit.
They won't settle with you and they won't extend the time. Get a lawyer before the clock runs out and they laugh at you.

The insurance co. Hopes you don't protect the two year statute. They won't extend. I worked for one of the big ones and I know how they think. Don't hope for what won't happen. You should consult an attorney to protect your rights. I hope this helps. Bob (818) 222-2433
