I think you need to re-read your question and ask it again. I can't tell if your daughter lives with you or with her father. In general some of the questions I would consider before filing a law suit would be who was responsible for her at the time of accident? Who was the automobile registered too? What were the circumstances under which she was driving? Who has the most insurance coverage? Those are some of the questions I would think most potential plaintiffs will determine when they go after someone. However, if I thought both parents were aware of the the situation I would go after both parents for negligent supervision in allowing her to drive.

Good luck
