Legal Question in Personal Injury in California

my 5 yr old child is in the Los angeles unified school district and was accused of sex assault on another student for touoching inappropriately.. is it legal for the child to be questioned by the prinicpal in private prior to either parent being called and alerted of the situation?

The parent does NOT need to be included. However, the school IS required to call the police! Probably the principal did break the law, but in your child's FAVOR.

Mr. Stone could be correct about the school being obligated to call the police, but really?? This is absurd!

Dear Parent,

I responded to your lawguru question back on Nov 10 regarding your 5 year old child�s situation, but I have not heard back from you.

I consulted with a child psychologist about your son�s situation (anonymously of course, because I do not know who your are) and she told me what I already knew, which is, a 5 year old child does not have the capacity to commit a sexual assault. When Mr. Stone, the other attorney said that the school should have called the police, maybe he�s right legally, but socially and morally, the idea is crazy and absurd.
