Legal Question in Personal Injury in California

Almost 2yrs ago i was involved in a accident, it was ruled as not my fault.now i just found out the other party is sueing my insurance company.i beleive the reason is they found out i was cited at the hospital for d.u.i..

as of this time there has been no claim filed against me but they can be waiting until my time stipulation to end in july of this year.so that i can't file a claim against them.i feel i am the one that should be sueing because this accident has caused me thousands of dollars out of my pocket not to mention that it cost my insurance company over $90,000.00.until this day i have permanent damaged to my hand and wrist,i am reminded of it every day.it has limited to what i can do at work and in my everyday life. i feel i should be compisated for my injuries.so i guess my question is what should i do ?

i am afraid they are going to wait until i can't sue them and then they are going to sue me because my time is up in july to file a claim but theirs isn't up for 2 more years because the party involved is a minor.

should i seek counsel or would it be a waste of time because of the d.u.i. ?
