Legal Question in Personal Injury in California

Acceptable claims

I was rear-ended by a car and pushed into the car in

front of me. I was taken to the hospital in an

ambulance and began experienccing medical problems

that night upon release. The doctor cannot say if the

accident caused the problems or not. I am soon to

leave the country and would like to settle this. My

medical situation is continuous. How do I determine

what is a fair settlement? I don't know if it matters,

but the other driver has the same insurance company

Re: Acceptable claims

It is impossible to evaluate yor case on the facts given. What are your symptoms? How much are your medical bills? What future treatment do you need? How old are you? Did you miss any time from work. Perhaps you should see a medical specialist who can tell you what injuries are related to the accident.

Re: Acceptable claims

might consider not being in a hurry to settle if you are still treating.

With same insurance company, may not be a big problem but caution is dictated.

Re: Acceptable claims

Talk with a personal injury attorney--he or she can give you an idea of the value of your claim and tell you what's involved in pursuing it.

Re: Acceptable claims

I strongly suggest that you get your case evaluated both medically and legally? If your injuries are significant, you will probably need future medical care.

You also need to know the amount of insurance coverage avaiable for the party at fault and the extent of his/her assets, in case he/she is a multi-millionnaire with only 15/30 liability limit.

Get a lawyer ASAP. My .02 cents.
