Yes, of course you can get in trouble for not having insurance. By law in California, you are required to have insurance. If you are in an accident and don't have insurance, you can potentially lose your driver's license. If the other party made a claim to his insurance company, he can possibly cancel the claim, but you are still likely to get an inquiry from the DMV. Get insurance ASAP.

Depending on how far along the other guy is with his company, I guess he could cancel his claim if he was willing to trust that you would pay all his repair damages and possibly a car rental bill. If his company handles the claim, they may come to you for reimbursement.

With no insurance, first you can have problems registering your car. Then, if you're stopped by a cop for any reason, he can ask for insurance and if there is none, you can get a ticket. In an accident, you have no one to back you up and if the damages are over $750, the DMV can suspend your drivers license. Better to have the coverage.
