Legal Question in Personal Injury in California

accident report Id's wrong driver at fault

In a bizzare incident at a parking lot a county bus crashed into me as I attempted to pass him. The local police responded and made a report (which took them 5 weeks to complete). When I finally got the report I was named as driver #1. Do I have a right to contest the accuracy of the report, or hire my own expert to write an unbiased report. At the time of the incident no injuries reported, later I suffered muscle pain. Little damage to my vehicle but since I am #1 what can I expect by way of liability. Can I sue the county bus system.

Yes you can sue. However, must file claim with county. Very short time limitation, much shorter than statute of limitations. If not file claim, likely not pursue claim in court. You can contact police and ask that the report be reviewed. 800-685-6950

You can probably sue the County, if you comply with the applicable and very short claims statute time limitations, WHICH IS SHORTER THAN THE STATUTE OF LIMITATIONS.

The police report is not conclusive. If you sue in court and prove that someone else is at fault, you can recover.

Police reports can and do contain errors. However, you will need an attorney to represent you if you wish to recover any damages.
