can i take action against a dr that did an incomplete breast reconstruction on me 10-11-2010.

You need to speak to an attorney, because you have an issue with the statute of limitations. The statute of limitations in California for a medical malpractice claim is 3 years from the date of injury, or 1 year from the date of discovery of the injury, whichever occurs first. (Code Civ. Proc., sect. 340.5.)
