taken advantage of by san diego trolley
i was only 20 years old and just had my son. i went out one day to ride the trolley with my sister. when the trolley stopped i push the button to get out twice before it would open, i tried to go out after my sister but the doors got jammed!!
they usually bounce back off of you, but this time they didn't . my son fell out of my arms unto the ground and it all happen so fast i almost passed out screamming and people were trying to help me by pushing the emergency button that failed to work until half way down the tracks. my son was rushed to the hospital and had bumps and bruises and marks all on his body. no broken bones they says. today i have had to get braces as well as a retainer due to his jaw being out of line, he acts slightly slower than other kids and i think it is due to that accident. he still has that bump on his head from the accident years ago.
i filled a claim with them at the time and was told by the supervisor tim at the time that that trolley was out of order and that they made mistake by connecting it for service. he appoligizes over and over, after that i could not reach him and no phone calls was returned.
can i still sue on my son's behalf?

I have three questions:
1. How old is your son?
2. When did this happen?
3. Do you know if the trolley is still in business?

If your son is still under the age of 18 you still have a right to sue as his guardian ad litem. Since a claim was opened with the company they may have filed one with their insurance company so even if the trolley company is no longer in business the insurance company may still be liable to pay for the damages.
