Legal Question in Personal Injury in California
Hello, My name is Ana. I have a question, I was involved in a car accident on a private property job cite... I contacted an attorney to see if I could get Legal advice to help speed up my treatment. Filed an accident report with the insurance of the responsible party and they agreed to cover the Dr. bills but I'm still in a lot of pain and don't believe I have gotten the necessary treatment for my injury. Although the police was notified they said they could not file a police report due to the fact that it was in private property therefor only an insurance report and claim was filed... Ok so my question is should this be a car accident claim or a workers comp claim because the attorney I contacted told me that it was a workers comp. I just want to recieve the treatment I need because it has been several months of pain and discomfort that prevent me from leading the very active life I lead up until the accident. If you could please help me clarified my curiosity I would really appreciate!

An accident can give rise to both a worker's comp claim, and a third-party insurance claim. You should get a second opinion, because that first attorney you spoke to might not be correct. You are better off to go to a doctor from the worker's compensation and if you need to be on disability the doctor can take you off work and you can receive disability benefits.
