Legal Question in Personal Injury in California
An attorney on behalf of the Defendant who personally caused emotional distress to myself and my family, however my father decided not to pursue action but I did can someone interpret this for me?
ABC company will agree to settle this matter for $xxx inclusive of fees and costs, in exchange for a release with confidentiality signed by you and your father, plus an indemnification clause. We will need your social security number to prepare the check request. We will also need the name of your father so that I can prepare the release.
Shall I sign it, is it harmless. I am trying to leave my father out of this. I accept responsibility and want to assure them that I will accept responsibility if anyone else files suit. Noone will from my household. I thought the release was sufficient, but this indemnity clause is unknown. I don't want my dad to sign, nor do I want him to be anywhere near legal problems. Could it be his age they are afraid of.

This is too complicated. It is very difficult to understand the situation from your question. You really need to consult a lawyer because your question indicates you are very confused and you need personal attention where a lawyer can ask you questions, review the documents and give you specific advice.
Mr. Carballo is correct. No one can advise you to sign an agreement that hasn't been reviewed. No one really knows what it says.
