Attorney fee

my attorney's percentage for my case was 33 1/3 percent if set for abitration then it goes to 40 percent, he made a date but cancelled because of another surgery on my knee, the other side settled out of court and we never went to arbitration should he get the 33 1/3 or 40 percent?

I agree with Mr. Cohen. I have seen some fee agreements that jump to a higher percentage when the matter is SET FOR arbitration and some when the arbitration commences. It would depend on the exact language of your agreement and no one can answer that without seeing it.

Before I could venture an educated guess, I'd have to have more education. I would need to see the retainer agreement, the court docket, the state of the pleadings, etc. For instance, it depends on the exact language of the retainer agreement with regard to arbitration.
