Legal Question in Personal Injury in California
Attorney performance in legal representation
My husband and me had a car accident oct 98, we were not at fault and that has been cleared up in police report. The company who's commercial car caused the accident has already paid for all other cars involved in the accident. Our attorney is very busy in court and we haven't receive any status reports, he doesn't return phone calls and when we get to talk to him he says he will send something. He submited a sue on the first anniversary of the accident so to keep the thing open.
How can we send a complaint? is he forced to give us reports? the paramedic companies keep sending us letters from collection bureaus, and the lawyer says not to pay attention to them.
Let me know what should I do.

If he has filed a lawsuit than your rights are protected. Have you received any type of questions from the defendant or their lawyer? Most courts require a status conference 4 months from the date the lawsuit was filed. By this time preliminary discovery should have been completed. This means that you should have received a stack of questions called "Interrogatories" and "Request for Production of Documents." These same documents should have been sent to the defendant by your lawyer. It sounds like this guy has dropped the ball. If he isn't doing what he is supposed to do the court might dismiss the lawsuit than your case is over. You can sue him for Malpractice, but that takes a lot of time and money. I have practiced law for over a decade and have had many clients come to me because of attorneys like this. I would be happy to speak with you and at least determine what your lawyer should be doing so you can confront him. I can be reached toll free at 877-546-9918. The consultation is free. The first sign that an attorney is not doing what he is supposed to be doing is his client asking questions on the internet about their case. It is time to get another lawyer. If you don't call me call someone so that you can protect your rights.
Sincerely,
John Hayes, J.D.

he is required to keep you informed about your case. Just hire a new attorney.
