Legal Question in Personal Injury in California

Attorney problems

I think we maybe having some

problems with our attorney. They tell

us that my son has to wait until 21

to get his money from a settlement,

which the attorney already has.

however there is a signed order

stating 18. Nothing showing 21. I

asked for copies of what they are

referring to, but still have not

received it I reviewed everything

online court records and again

nothing showing 21, only 18. We are

being told that they are going to

court to get the order ''changed'' so

he can get the $ now that he is 18,

but on the court records, it only

states ''hearing: proof a receipt of

deposit'' first hearing no one showed

up, second it was continue nothing

indicating any petition filed, nor ever

signed by us. I would think if they

are filing a petition, my son would

need to sign it? Is my son being

strung along?

Report the issue to the State Bar Association and apply to the court to substitute attorneys.

Contact the local bar association or the state bar and make a complaint.

Have your son (now that he is 18) write a letter to the attorney demanding an accounting of all funds within 10 days. (Write, do not call). Follow up with a letter to the State Bar of California, Office of Chief Trial Counsel if you are not satisfied with the response you get.
