Legal Question in Personal Injury in California
auto accident
I hired an attorney who assured me
that my son would get the proper
medical attention he needed for a
brain injury rollover accident and
after 4 years of litigation he saw no
doctors, went to no trials and never
had so much as a deposition taken.
My son ended up getting into trouble
with the law due to head injury and
is now serving time in a state prison
and his attorney flip sides and got his
passenger a large settlement. We
had almost minimum contact with
this attorney who claimed that now
that my son was a criminal he could
not get him anything! All this could
have been avoided 3 years before
when I pleaded with the attorney to
get him some professional help for
his traumatic head injury. Now I
won' t see my son for 9 years and
the attorney got $190,000.00 for
doing nothing! Can I pursue this?

Sure. Report the matter to the State Bar. They will investigate. Have a lawyer that does lawyer malpractice review the case.

You have stated some very confusing facts.
You can pursue it, as Mr. Roth points out, through the State Bar. Moreover, it is not the lawyer's duty to get medical help.
