Legal Question in Personal Injury in California

auto accident no injuries

I was involded in an auto accident on 3/23/06 is was a hit and run. other driver was visibly drunk but do to leaving scene of accident unable to confirm this. did get licence plate number gave to local police but other party hid out for 4 day before turning himself in. my vehicle was totaled do to nature of damage. other insurance gave me an offer but I do not wish to accept this. My insurance cant help me do to the way ias was done . my question is if I were to accept offer can I still sue other party for more? This was my only vehicle and my business as well I had to come up with money (which I dont have)to get a replacement vehicle. Can I do anything? the wont pay enough to pay off my autoloan.
