Legal Question in Personal Injury in California

auto accident: does my med. ins. get compensated from me or insurance co. direct

After my accident (reareneded by other driver),

I received treatment from my own medical provider,

for basically a "whiplash" injury. If the insurance

co. is settling the doctor bills directly, what am I

entitled to as compensation in regards to my $5 co-

payment I was charged at each visit to the doctor?

Also each prescription.? I have been told I am

entitled to 4x the amount. Is this accurate?

For the money you actually paid out-of-pocket you are entitled to that amount. In addition, if you are seeking damages for pain and suffering you need to take into account your total medical bills. There really isn't any formula, but adjusters will usually offer twice your medical bills as settlement. However, if you hired an attorney those numbers would probably increase.
