Legal Question in Personal Injury in California

I was in an auto accident, the other person involved in the accident was in a rush to take off, hands me a small piece of paper with his insurance info. photo copied on it. Spoke spanish saying got to go got to go. I was pretty much out of it, but had some sense to say you need to stick around the police have been called and a police report needs to be taken. He shook his head and drove quickly off. Shortly after a police arrived on the scene. The officer said to me, that there had to be two vehicles presant in order to fill out an accident report. I told him that the other guy would not stick around. He just said dont know what to tell you, there has to be two or more vehicles involved in order to make out a police report. Something doesnt seem right about this.

The police are wrong. This is a hit and run accident if the other party did not provide all information required by law which would be their name, address, driver's license #, and car license #. You should report this accident to your own insurance company immediately and also go back to the police department and insist on a police report. If you were injured in the accident or you have more than $500 in property damage to your car, you are required to file an SR1 form with the Department of Motor Vehicles. The officer was probably trying to save himself some work, because what he told you is completely incorrect, but it may not matter. A police report is only a tool for assisting with the processing of a claim. As long as you have the insurance information of the person who hit you, then an attorney can take it from there. The most important thing for you to do right now is seek medical attention. You said you were "out of it." If you hit your head, you may have a serious injury. Call me toll-free 24/7 and I will discuss the case with you in further detail: 877 LION-FOR-LAW (546-6367)
