Legal Question in Personal Injury in California
auto accident
My 18 year old daughter was hit by a drunk, unlicensed driver, head on. He was going southbound on the northbound fwy. Amazingly, she and her passenger were not injured fatally but were very bruised, bumped, and back, neck and head pain. I picked up the CHP report today, and it is showing the driver that hit her had insurance. She had full coverage and bought the vehicle new 1 month ago. Should we consult an attorney for further advice and possibly protection in case the two insurance companies have conflicts, etc?

Yes, you should consult an attorney.
What your insurance company paid is still recoverable by you (although you may have to reimburse the insurance company). Plus, there could be substantial damages suffered by your daughter which were not covered by her policy.

I am glad to hear that your daughter is okay. Certainly those of us who have handled these types of cases have dealt with clients who fare much worse. That being said, your Daughter is entitled to be fully compensated for her injuries (her passenger as well.) Unfortunately, insurance companies don't always act solely in your best interest. For example, there are many variables that need to be taken into account such as long term impact of the injuries (especially because she is 18.) Do not talk to investigators from driver's company. I am assuming you have already notified your insurance company.

I would be very cautious about assuming that your daughter is 100% okay. I have two daughters myself, and I understand a parent's need to know that everything is all right. The problem is, many different kinds of injuries take time to reveal themselves. If we jump too soon to the conclusion that everything is okay, the only one who ends up benefitting is the SOB who's responsible.
Definitely retain an attorney. I would meet with you and your daughter in person and conduct an extensive interview, then if necessary refer her for evaluation by specialists. The sooner you move on this, the better, because insurance companies will be quick to accuse you of "fabricating injuries" if you delay.
