Legal Question in Personal Injury in California
Auto Accident
My 16 yr old pulled into an intersection and hit a car. Thier car was totaled and the driver went to the hospital. I don't know if he is insured on our policy yet. They have retained a lawyer. I anticipate they will try to milk this for all they can get. (you know how people are these days) What are my options? Do I need an lawyer also? I am deep financial turmoil as it is. Would a BK help? Let me know. Thanks Joe

Refer this to your own autmobile insurance company. They will defend you, provided your son is insured under the policy. Otherwise, you are in deep doo doo.

No, would not file bankruptcy. It's way too premature. It can be done at anytime.
If your son was uninsured, it may be that the other person had "uninsured motorists" coverage. If so, that person's insurance company would handle the claim.
As for you, if you own the car, you need to contact your own insurance company (they have lawyers). As to your liability, if you own the car, under the California Vehicle Code, you would be limited to $15,000 per person, or $30,000 per accident. However, this would change if there's a negligent entrustment issue (e.g., someone let your teenager drive when he shouldn't such as having no driver's license or was intoxicated).
