Legal Question in Personal Injury in California

automobile- repairs required to collect claim

My car was hit while parked in my drive way. Am I entitled to collect the estimated cost of repairs, even if I do not intend to repair the damage?

You are entitled to collect the reasonable cost of repairs. Get an estimate from a reputable body shop. Also, remember that you are entitled to loss of use, or rental expense if you fix the car, for a reasonable amount of time. You can read about loss of use here: http://www.calpiblog.com/2006/03/new_podcast_rel.html and here: http://www.calpiblog.com/2006/03/insurance_to_ma.html and here: http://www.calpiblog.com/2006/01/rental_cars_wha.html

Good luck.

Re: automobile- repairs required to collect claim

If someone else (not you) did the damage, the party responsible for the damage should compensate you for the damage he or she caused. What you intend to do with the money is your own concern. To prove the damages, though, you would need an estimate from a reputable body shop.
