Legal Question in Personal Injury in California

My boyfriend and I have had a three year relationship. It has been rocky due to other women's jealousy coupled with his refusal to stop smoking weed for anxiety and anger purposes as per californian law. For the last 2 weeks he is ignoring my love for him, whilst going to parties. I agree that it is ok for him to do this if we are no longer in a relationship; so I would like to finalize our three year relationship in a way that I feel ok about what has happened to me because of him. Last summer i fell and fractured my elbow bone which needed surgery and now i have a big scar down my arm. I would like my boyfriend to donate $2,000 to a charity for domestic violence to show remorse for the abusive way he treated me whilst we lived together. Because i am left with a large scar that put me out of the work force during physical therapy, I believe i need some satisfaction in the closure to our long term relationship. My boyfriend has a very nice side to his personality and that is why i thought he was the man of my dreams, but he is easily swayed by other people, and his family has money; so a 2,000 donation to charity would be nothing to them. But it would be something to me. I loved him. Can i send him a lawyer's letter demanding him to pay for my scar by donating to charity for domestic violence? If he does this I will know never to look for love from him again. I hate the way he strings me along.

You hate his smoking, and the way he strings you along, so you are going to blame your fall and broken elbow on "domestic violence"? That would be an insult to real DV victims. Maybe I'm missing something, but why should he have to pay anyone on account of your injury?

You imply that your injury resulted from domestic violence, but you say only that you "fell". This inconsistency makes your question hard to answer.

If your boyfriend injured you and the statute of limitations has not run, then you can sue him, which also means you can demand a settlement before doing so. You can also offer to release him from liability in exchange for the donation you describe. But if he didn't cause the injury then you can't use it to extract funds from him, even for a worthy cause.
