Legal Question in Personal Injury in California

Hi my brother was in a car accident, he was driving my moms car their agent is asking if she had any other type of coverage and my moms insurance is only paying 5000. Can she be sued since its her car or so they go after the driver? There was no police report and the other driver admitted that he was driving really fast.

The $5,000 probably is the medical payment provision of your mother's policy. It's a no-fault coverage that will pay the medical bills of an injured person up to the stated limit. If the other driver was at fault, then a claim and/or lawsuit might be brought against that person and the owner of the other vehicle.
