my brother was in a car accident with his friend an his friend had passed away and no one knows who was the driver and my brother in hospital what would we have to do so the cops dont talk to him while he is in the hospital or with a lawer by his side

I hope your brother recovers quickly and my condolences to his friend's family. I would suggest that an attorney be retained by your borhter and the family for the deceased friend/driver sa that the attorney can assist with the police. Additionally, there are options under the policy covering the car your brother was in (assuming that it was insured) regarding a hit and run if that is what your brother was involved in.
