Legal Question in Personal Injury in California
Business's liability for stolen property from their store
Would a gym be liable for personal property stolen from their facility upon the abrupt closing of the gym? No notice of closure was given. The items were in a locked permanent-locker supplied by the gym and rented monthly. The gym closed; items were removed from the lockers and placed in plastic garbage bags; the gym window was smashed in and items stolen from those bags. Would they be negligent in the handling of property and therefore be responsible to replace it or pay an insurance deductable?

Based on the fact situation you presented, it would appear that the gym did not handle your personal property in a responsible manner. You would have to find the corporate office or an insurance representative to present your claim for your lost property or an insurance deductible. You would have to show that the gym did not give you adequate notice for you to remove your property and that they did not take reasonable precautions in safe guarding your property. If the gym or their representatives did not want to acknowledge any fault, you could probably take your case to a Small Claims Court.
