Legal Question in Personal Injury in California

Car Accident in Ca, at a stop sign at a t-intersection at dusk, I turn left, car coming from on my drivers side does not have on headlights, I do not see car until impact, have witnesses that driver did not have lights on. A percentage of fault for both of us, who is the majority at fault? Me for turning left or her for driving illegally with lights off at night?

Impossible to determine from what you say. It depends on how dark it was and how negligent the other person was for not turning on the lights. The darker it was, the more negligence on the other side.

The answer above is correct. It will all depend if it was so dark the other car should have had it's headlights on. If you could not see them without lights, then the majority, if not all responsibility would be on the other party. If you were injured, contact us for a free consultation at www.lawkuhn.com
