Legal Question in Personal Injury in California

HI

my wife was rear ended 2 days ago. I took h er to the er and they said it was whiplash, a pinched nerve and a sprained wrist. The person who caused the accidents insurance company called and tried to make my wife take 500 and sign a waiver. I told her not too. what should I do in this situation. I dont know how serious or long term the ijuries will be. Should i negotiate with the insurance company or get an attorney. she does hae preexisting back and neck injuries that might complicate things.

If the ER indicated a pinched nerve, then the case is worth much more than $500-- obviously.

The prior injury just means that your wife is an "eggshell"-- or, as they say in the jury instructions-- "unusually susceptible to injury." Whatever pre-existing condition she might have, it could also be aggravated, and they're still liable for that aggravation.

Sorry to hear about your wife. Nobody in your family should speak, at all, to the other person's insurance company until a lawyer has been consulted. Do this right away. Watch out for legal time limits.

I would not talk to the insurance company until you know the extent of your wife's injuries. She may recover quickly. She may take a long time to recover. You don't know. And, until you know, you don't want to say anything to the insurance company. Talk to an attorney about the specifics of the case.
