Car Accident

I was involved in a car accident, where the other person was driving a rental car. The police report said that it was here fault, but the thing is that i didnt have insurance at that time. Come to find out that the other person didnt have insurence either.

Is the rental car place responsible for the damages on my car?

Or do i have to go to court?

The rental car company, as the registered owner of the car are liable under 17150 of the Calif. Vehicle Code for your actual damages, such as property damage, medical bills and loss of earnings but not for pain and suffering since you did not have insurance on your car. The property damage is limited to $5,000 or $10,000. You need to look at 17150 to determine this.

The owner of a car is responsible for the damage that results from the negligent operation of the car by a permissive user.
