Legal Question in Personal Injury in California

Car Accident

I was involved in a car accident. The police report says I am at fault. I think the report is wrong. I was injured and have been to the doctor. Is there anything I can do to be compensated for my injuries?

Re: Car Accident

Of course. The police report is not admissible evidence in civil cases. It cannot be used against you. At any rate, the police report is just one officer's quick opinion based on what he/she THINKS happened. The officer didn't witness the accident. Give us a call. We will be happy to help you.

The police report does not determine fault for compensation, it just makes it much much harder when it is against you.

Re: Car Accident

Sure. Police reports do not determine fault. I reflects only the judgment of the officer based upon information the the officer received second hand and may be wrong.

If you have significant injuries, have the case reviewed by a qualified attorney. Otherwise, sue in small claims court.

You should contact a PI atty in your area, have him review the report to see what can be done. You can do a supplemental police report yourself. Any witnesses favorable to you? If you make a claim against the other driver, you have the burden of proof. How will you prove the other driver was negligent? Get a legal opinion.
