Legal Question in Personal Injury in California
I got into a car accident on March 1st 2010 on Cedar and Santa Ana street in Bloomington I think that is the city. I was driving and the guy in front of my sped up to catch the light before it turned red we were going I say 50 miles per hour and I didn�t slow down fast enough thinking he was going to take the light so I was going pretty fast still then as I got closer the guy realizes he wasn�t going to make the light so he literally slamed on his breaks so I had to do the same he was over the double lines at the light already, well anyways I didn�t stop hard enough I guess because my car slid and hit the back of him. So needless to say nothing happened to his car no damage at all but my car is messed up, so now he put in a claim that I caused damage to his bumper and engine. I have pictures to prove there is no damage to the bumper. So I didn�t have insurance at the time but I got insurance that same day. Please help to see what my chances are if I get suied.

First of all, if you rear ended, it will be considered your fault. You have to maintain safe distance. If you have picture to prove that there is no damage then that is all you can do. Otherwise, you will have to pay for the damage- not to mention the trouble with DMV for driving without insurance.
The first step is to file a form SR-1 with the DMV. Because you didn't have insurance, your license will be suspended for six months or until you pay for the damage.
