Legal Question in Personal Injury in California

Car Accident Help

I was in a car accident 3 years ago. I was rearended on a freeway i did not have any insurance at that time. The person that rearended me was underage and did not have insurance it was a rental car. The person who rented car had insurance but he was nowhere in the car. Since, I didn't have any insurance I lost my license which i can accept. I did not received no citation but yet after three years i received a letter from their insurance company saying i have to pay an extended amount of money. I know i wasn't responsible for the accident especially when i know i got rearended on a freeway. Is there anyway i can overturn this judgement against me?

I agree with Mr. Eagle. There's something missing. I am only assuming that there's no judgment. The other driver's insurance company probably reimbursed the rental company for damage to the rental car. Now they are coming after you in "subrogation" to pay what they paid. If there's no court case, you're not obligated to do anything. If there's a court case, you should have been served with court papers. Check on the court's website -- or go to the courthouse -- and search your name and see if there's a case against you. If so, copy the summons, complaint, and proof of service (and anything else filed in the case) and visit with an attorney to assist you. You might overturn a judgment against you if it was entered fairly recently. But don't hesitate to do the research.

Something doesn't make sense. With you having no insurance, that just means you can't collect pain and suffering money. But if you're not at fault, how did another driver or ins. co. get a judgement against you? Were you ever sued or served with a lawsuit? What do you mean by "extended money"? You're leaving something out of the story. You need to call a PI atty for a consultation even if you have to pay for it.
