my car was hit while park on a residential street the insurance company wont pay they say the driver was not on the policy but the owner of the car loaned out the car can i sue the insurance company to fix my car

Sue the owner of the car, and also the driver if possible. You can sue in small claims court without a lawyer for up to $7500.

You can't sue someone else's insurance company. Mr. Stone is right about whom to sue. Much simpler, however, would be just to submit the claim to your insurance and let them sue for reimbursement.
