Legal Question in Personal Injury in California

Her car was hit on rear bumper at an angle, mine was on passenger side of car. Its been almost 2 years, no liability determined. They claim they have a witness. Witness statement was from her neighbor and within statement she was there but didn't witness it. Frustration with lawyer and doc. became too much. Filed sub-of attorney, now i'm pro-per. Defense counsel wants deposition. And mandatory mediation is scheduled by Jan. Afraid to give deposition without lawyer, and postponed it to try and find lawyer. Now i have been unable to find lawyer willing to take case.

Can i still schedule her for deposition? How can I get them to come to a fair settlement? I Can't actually represent myself in a real court case. If it was small-claims maybe.

I don't know what to do, and don't want to have my case thrown out for not complying with court procedures.

My case is cut and dry, Def. argues that she was already traveling in same lane. Evidence is clear from point of impact, I know she was in reverse and still coming out of driveway. She would have to yeld to oncoming traffic before entering my lane of travel. At scene she was apologetic, and admitted fault.

Cops said that they didn't want to file report for bloody nose. There was 8k in damages between the two cars. I started to have severe back, neck, and head-ace pain the next day. Whent to chiro, and so add 5,600 in medical bills.

As you can now attest, I'm sure, one of the worst things a person can do is get involved in Superior Court litigation "in pro per." It's very complicated, and there are serious consequences with even small mistakes. And in the end, if you survive discovery, you still have to make it through a jury trial.
